Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and JSG Estate Liquidators LLC, a Colorado limited liability company (“Company,” “we,” “us,” or “our”), governing your access to and use of Homeroom Tutor, our AI tutoring web application (the “Service”).
1. Acceptance of Terms
By creating an account or otherwise using the Service, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service. If you are accepting these Terms on behalf of a child, you are agreeing on behalf of both yourself and the child, and you are responsible for the child’s use of the Service under the account.
2. Eligibility and Age Requirements
Homeroom Tutor is intended for learners of any age. Because federal law (COPPA) protects children under 13, the following rules apply:
- Anyone may use the Service, but at signup we ask for a birth year to determine whether a user is under 13.
- If a user is under 13, the account must be created and owned by a parent or legal guardian, who provides verifiable consent before the child uses the Service. The parent/guardian is the account holder and is responsible for the child’s activity, for supervising use of the Service, and for compliance with these Terms.
- Users 13 and older may create and control their own account, subject to any additional age-of-majority or parental-involvement requirements imposed by applicable law in their jurisdiction.
- You represent that all information you provide at signup, including birth year and grade level, is accurate.
3. Description of Service
Homeroom Tutor provides AI-powered tutoring across a range of subjects and skill levels. The Service uses large language model technology to generate tutoring responses, maintains a persistent per-learner memory to personalize sessions over time, and allows learners to indicate mid-session teaching-style preferences that the system uses to improve future sessions. Features, subjects, and functionality may change, be added, or be removed over time.
4. Subscription and Billing
- Price and trial. Homeroom Tutor is offered as a paid subscription at $14.99 per month, with a 7-day free trial for new subscribers. If you do not cancel before the trial ends, your paid subscription begins automatically and your payment method will be charged.
- Billing. All payments are processed securely by Stripe, our third-party payment processor. We do not store your full card number. By subscribing, you authorize recurring monthly charges to your payment method until you cancel.
- Cancellation. You may cancel your subscription at any time through your account settings, effective at the end of the current billing period. You will retain access to paid features through the end of the period you already paid for.
- No partial refunds. Charges are non-refundable for partial months. If you cancel mid-cycle, you will not receive a prorated refund for the unused portion of that billing period.
- Price changes. We may change subscription pricing prospectively. We will provide reasonable notice of any price increase before it applies to your next billing cycle.
5. Acceptable Use
You agree not to use the Service to:
- Violate any applicable law or the rights of any third party;
- Upload content you do not have the right to share, or that infringes intellectual property or privacy rights of others;
- Attempt to circumvent rate limits, security measures, or account restrictions;
- Use the Service to generate harmful, harassing, deceptive, or illegal content;
- Misrepresent your age, or a child’s age, to bypass the parental-consent requirements described in Section 2 and our Privacy Policy;
- Reverse-engineer, scrape, or resell access to the Service without our written permission; or
- Interfere with or disrupt the integrity or performance of the Service.
We may suspend or terminate accounts that violate these rules, with or without notice, as described in Section 9.
6. AI-Generated Content Disclaimer
Homeroom Tutor’s tutoring responses are generated by artificial intelligence models. While we design the Service to be helpful and accurate, AI-generated content:
- May contain errors. The tutor can make mistakes, misstate facts, or provide incomplete or outdated explanations. Always verify important information independently, especially before relying on it for graded coursework, exams, or other consequential decisions.
- Is not professional advice. Nothing generated by the Service is a substitute for professional medical, legal, financial, psychological, or educational advice from a qualified human professional. Do not use the Service as a substitute for such advice, and seek appropriate professional help for matters requiring it.
- Carries no guarantee of accuracy or outcomes. We do not guarantee that use of the Service will improve grades, test scores, or any other educational outcome, and we make no warranty as to the accuracy, completeness, or reliability of any response generated by the tutor.
7. Intellectual Property
The Service, including its software, design, and underlying technology, is owned by the Company and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for your personal, non-commercial educational use, subject to these Terms. You retain ownership of content you upload, but you grant us a license to use it as needed to operate the Service (including sending it to our AI and infrastructure providers as described in our Privacy Policy).
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY AI-GENERATED CONTENT WILL BE ACCURATE OR COMPLETE.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE COMPANY AND ITS OFFICERS, MEMBERS, EMPLOYEES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE (3) MONTHS PRECEDING THE CLAIM.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, including for violation of these Terms. You may stop using the Service and cancel your subscription at any time as described in Section 4. Upon termination, your right to use the Service ends immediately, though provisions of these Terms that by their nature should survive (including Sections 6–9) will continue to apply.
11. Governing Law
These Terms are governed by the laws of the State of Colorado, USA, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Colorado.
12. Changes to These Terms
We may revise these Terms from time to time. If we make material changes, we will update the effective date above and provide reasonable notice where appropriate. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
